Former President Trump Seeks Supreme Court Permission for Military Reserve Forces in Illinois

This move is part of a wider push to widen the homefront role of the military in several urban centers under Democratic control.
Legal Battle Over Military Presence
In an urgent petition, the federal legal authorities pressed the bench to overturn a previous judicial decision that had blocked the sending of several hundred military reserve troops to the greater Chicago.
The district judge had raised doubts about the administration's justification for activating the guard, challenging its reasoning in light of the situation on the ground.
A appellate court affirmed the previous order on Thursday, maintaining the activation on hold while the judicial dispute proceeds.
Government's Justifications
The federal legal representative, acting for the administration, wrote in the latest petition that federal law enforcement have often been “intimidated and assaulted” in Chicago and the outlying area of Broadview area.
This site is home to an ICE detention center.
The president has previously sent state guard personnel to the Windy City and Portland, Oregon, following previous sendings to Los Angeles, the city of Memphis, and Washington DC.
The administration has argued that armed forces involvement is needed to control demonstrations and support immigration enforcement.
Political Resistance
Democratic officials have strongly opposed the move, saying that the president’s claims are greatly exaggerated and driven by politics.
They allege the former president of exploiting his authority to retaliate against critics.
Judges have also expressed doubt about the White House's description of events.
City officials say that demonstrations over ICE activities have been largely modest and calm, contradicting the administration's characterization of “battlefield” circumstances.
Legal Basis
At the core of the dispute is the government's invocation of a national law allowing the executive branch to take control of the military reserve only in instances of uprising or when “unable with the regular forces to carry out the laws of the nation”.
The administration argues that the forces are required to protect government buildings and officers from demonstrators.

Earlier this month, the administration took control of three hundred troops of the Illinois national guard and directed more Texas national guard troops into the Illinois.
As state authorities condemned the decision, the White House increased his statements, urging the apprehension of the mayor of Chicago and the state's chief executive, both Democrats, accusing them of neglecting to safeguard ICE personnel.
The state of Illinois and Chicago together took legal action against the White House to block the activation.
On October 9, the presiding federal judge, appointed by Joe Biden, handed down a temporary injunction blocking the order.
